1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and Finally Financial Services Inc. (“Finally”, “we”, “us”). By joining our waitlist or using our website and services, you agree to these Terms. If you don't agree, please don't use Finally.

2. What Finally is, and what it isn't

Finally analyzes the financial information you provide and gives you a financial health report, score, insights, and suggested actions. This is provided for informational and educational purposes only.

Finally is not a bank, broker, investment adviser, accountant, or financial planner, and nothing in the service constitutes financial, investment, tax, or legal advice. Your situation is unique, and our insights are based only on the data you share with us. For decisions with significant consequences, consult a qualified professional who knows your full picture.

3. Who can use Finally

You must be at least 18 years old and reside in Canada or the United States. By using Finally, you confirm that both are true.

4. Your data and your content

The financial data you upload belongs to you. You grant us permission to process it solely to provide the service to you, as described in our Privacy Policy. You can delete your data at any time, and we never sell it.

You are responsible for making sure the data you upload is yours to share, accurate, and exported from your own accounts.

5. Acceptable use

You agree not to:

• Upload data that belongs to someone else without their permission.
• Attempt to breach, probe, or circumvent our security measures.
• Use the service to break any law, or interfere with other users' use of it.
• Copy, scrape, resell, or reverse engineer the service or our scoring methodology.

6. Our intellectual property

Finally, including the website, the product, our name and logo, and the scoring methodology behind your report, belongs to Finally Financial Services Inc. and is protected by intellectual-property laws. Using Finally doesn't give you ownership of any of it. You may use the service for your own personal, non-commercial purposes, and nothing more.

If you send us feedback, ideas, or suggestions, we're grateful, and you agree we can use them to improve Finally without any obligation to you.

7. Free and paid features

The core report is free. Some features may require a paid plan; pricing and terms for paid features will be presented clearly before you pay anything. We may change, add, or remove features as the product evolves.

8. Disclaimers

Finally is provided “as is” and “as available”. While we work hard to make our analysis accurate and useful, we can't guarantee that results will be error free or that the service will be available at all times. Insights depend on the quality and completeness of the data you provide.

9. Limitation of liability

To the maximum extent permitted by law, Finally will not be liable for indirect, incidental, special, or consequential damages, or for financial decisions you make based on information from the service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred Canadian dollars (CAD $100).

Some places don't allow certain liability limitations or exclusions, including for consumers. Nothing in these Terms takes away rights you have under the consumer-protection laws of the place you live that can't legally be waived, and to the extent a limitation here isn't allowed where you live, it simply doesn't apply to you.

10. Termination

You can stop using Finally and delete your data at any time. We may suspend or terminate access if these Terms are violated. Sections that by their nature should survive termination (like disclaimers and limitation of liability) will survive.

11. Changes to these terms

We may update these Terms as the product evolves. If we make a material change, we'll update the date at the top and notify you by email or in the product before it takes effect. For changes that materially affect how we handle your data or your legal rights, we'll ask for your agreement where the law requires it. Continuing to use Finally after a change takes effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of law rules. Any dispute will be resolved by a court of competent jurisdiction in Toronto, Ontario. If you are a consumer, this doesn't deprive you of the protection of mandatory consumer-protection laws of the place where you live, or of any right you have to bring a claim in your local courts where the law guarantees it.
